Appellant James Calvin Segers challenges the district court’s dismissal of his 28 U.S.C. § 2255 motion as untimely. Segers contends that his § 2255 motion was timely filed, asserting that the applicable one-year period of limitation did not commence to run until January 25, 1999, when the Supreme Court denied his petition for rehearing of the denial of his petition for certiorari.
