The American Bank of Spokane, being insolvent, passed into the hands of the supervisor of banking for liquidation on April 14, 1932. Plaintiff brought this action against the supervisor to establish a preferred claim in the assets of the bank to the extent of five thousand dollars. After trial, the lower court entered judgment dismissing the action. Plaintiff appeals.
