On January 13, 2003, Michael Cornell Bulger filed a Rule 32, Ala.R.Crim.P., petition for postconviction relief, in which he requested that he be resentenced pursuant to the May 25, 2000, amendment to the Habitual Felony Offender Act ("the HFOA"), made retroactive by § 13A-5-9.1, Ala. Code 1975. The circuit court summarily denied the petition, and this Court affirmed that denial in an unpublished memorandum issued on January 23, 2004. See Bulger v.
