BACKGROUND AND FACTS

Because the underlying convictions are not the subject of this appeal, the facts of this ease are not in dispute. On February 3, 1993, Daniel Carter Killinger (Killinger) was charged by criminal complaint with one count of burglary. Killinger pled guilty to that charge, and neither that conviction nor the resulting sentence are subjects of this appeal.
