Defendant in error filed this action in the county court of Roger Mills county to recover on an insurance policy.' The parties will be referred to here as in the trial court.

The plaintiff in his petition alleges that on the 7th day ■of October, 1911, defendant issued to W. H. Lee an insurance policy in the amount of $700 upon a certain soda fountain and fixtures; that on the 25th day of January, 1912, the said W. H. Lee sold the property covered by said policy of insurance to Edward Lee, and on said date the defendant' indorsed its consent to said transfer on said, policy…
