MEMORANDUM OPINION AND ORDER
ALESIA, District Judge.
Before the court is defendants the individual police officers and the City of Chicago’s joint motion to dismiss Counts IV, V, VI, VII, VIII, and IX of plaintiff Eric Holder’s first amended complaint pursuant to Federal Rule of Civil Procedure 12(b)(6). For the reasons that follow, the court denies the individual police officers and the City of Chicago’s joint motion to dismiss.
