The instant adversary proceeding was brought to determine, as between the fee owner of real property and a tenant of the former mortgagee-in-possession, title to certain improvements made to commercial property located in Weehawken, New Jersey (“the Premises”). Although the tenant, WTW Realty, Inc. (“WTW”) concededly knew that its landlord, the former mortgagee-in-possession, Hartz Mountain Industries, Inc.
