ARRAJ, District Judge.

This case is before the Court at this time on defendant’s motion for a new trial.

The plaintiff brought suit claiming that he suffered personal injuries as a result of defendant’s negligence. The cause was tried to a jury on February 24 and 25, 1959. On February 25, 1959, a verdict was returned against defendant, awarding the plaintiff the sum of $10,000. A judgment on the verdict was rendered and docketed on February 26, 1959.
