Affirming.
Carlo Lawson, whom we shall call the plaintiff, suing by his next friend, recovered a judgment against the city of Pineville, which we shall refer to as the city, for $25,-'000, to reverse which the city has prosecuted this appeal. Some time about the year 1909, certain promoters subdivided a tract of land within the city of Pineville, which has since been known by the name of Newtown or East Pineville.
