MEMORANDUM and ORDER

JOYNER, District Judge.

Before this Court is Defendant OwensBroekway Glass Container Inc.’s Motion for Summary Judgment (Doc. No. 18) and Plaintiff Anthony Modaffare’s Response in Opposition (Doc. No. 21). For the reasons set forth, we will deny Defendant’s Motion in part and grant it in part.
