CLARY, District Judge.

This action arose out of a collision between the Liberty-type steamship Cal-mar and an anchored mud scow at 11:43% P.M. on the night of November :30, 1951, which occurred on the Horseshoe Bend of the Delaware River, approximately opposite the north end of .Mustin Field, a part of the Philadelphia Naval Base. From the pleadings and proof I make the following -
