ANDERSON, Judge.
This is an action for damages for personal injuries sustained by plaintiff when she fell while descending a stairway in a store operated by J. C. Penney Company. The action was brought against J. C. Penney Company, Ralph Miller, the Store Manager, and Wayne Johnson, a Floor Manager in said store. At the close of plaintiff’s case, plaintiff dismissed the action as against defendant Johnson.
