HOLLINGSWORTH, Presiding Judge.

This is an action in equity wherein plaintiff, Madeline Gerber Hegger, seeks a decree declaring her to be the “equitably adopted daughter” and sole heir of Mary L. (Kausler) Manwaring, deceased, and, as such, by virtue of pretermission from the last will and testament of deceased, to take the property, real and personal, of which the latter died seized. The defendant is Albert Kausler, a brother of deceased, who is sued both in his individual capacity q.s the sole legatee and devisee of all of the property of deceased and as executor of her estate.
