Owing to the fact that I am not able to agree with the disposition of this case made by the majority of this court I desire to respectfully enter my dissent.
*473This is an appeal from a judgment denying plaintiff’s application for writ of ■mandamus against the Hon. Nash Oliver, Justice of the Peace, Precinct No. 1, Place No. 2, McLennan County, Texas.
