*906In an action to recover damages for medical malpractice, etc., the defendants Thomas E Erhart and Thomas E Erhart, EC., appeal, as limited by their brief, from so much of mi order of the Supreme Court, Suffolk County (Rebolini, J.), dated June 18, 2009, as denied their motion for summary judgment dismissing the complaint insofar as asserted against them.
Ordered that the order is affirmed insofar as appealed from, with costs.
