This is a suit for damages for breach of a written contract for the purchase of three thousand bushels of No. 3 oats. A jury was waived and the caso tried before the court, resulting in a judgment for plaintiff in the sum of $567.34, and defendant has appealed.

The facts show that plaintiff and defendant entered into a written contract in St. Joseph, Missouri, on June 24, 1920. The contract recited that defendant purchased of plaintiff three thousand bushels of No. 3 oats at ninety cents per bushel, f. o. b.
