The issue before the court is whether the defendant’s application, made pursuant to the Civil Practice Law and Rules, seeking an “access order” in which the court would direct private individuals to open their home to defense attorneys and investigators to have it photographed and measured, is statutorily and/or constitutionally mandated. The home was the scene of several sex offenses alleged to have occurred five years ago.
