HAWTHORNE, Justice.

Defendant, W. C. Kaufman, Jr., has appealed to this court from his conviction of the crime of negligent homicide and his sentence to serve two years at hard labor in the state penitentiary.

Defendant was prosecuted under an indictment returned by the grand jury of Calcasieu Parish, charging that he “did, by the criminally negligent operation of a motor vehicle, kill one Richard E. Ayres, in violation of Article 32 of the Louisiana Criminal Code”. Ayres met his death as a result of being struck by an automobile driven by the accused on U. S. Highway 90 west of Lake Charles,…
