Plaintiff, in error brought this action in the court below against defendant in error to recover the possession of a certain tract of land. Plaintiff claims title to the land by virtue of two certain deeds executed and delivered to him by Al-berd Tiger and wife on the gist day of August, 1907, and on the first day of August, 1908, respectively. The land involved is the allotment of Yana Buffalo, a citizen by blood of the Creek Nation, who died intestate in the month of January, 1903.
