In the recorder’s court of Detroit defendants were convicted on a charge of being disorderly persons. They petitioned this court for leave to appeal. Incident to their petition the question of the constitutionality of the statutory provision under which they were convicted was raised. This was deemed to be of such importance that the court requested counsel for the respective parties to present the matter. It has been briefed and orally argued.
