This diversity action arises out of an automobile accident in which plaintiff was a passenger in an automobile driven by her husband, which collided with defendant’s car in Marion County, West Virginia. By order of this Court, defendant has brought in as a third-party defendant the plaintiff’s husband, alleg*281ing that any injuries sustained by plaintiff were caused by the husband’s negligence.
