The plaintiff instituted this action to recover from the defendants damages for personal injuries sustained by him as the result of a collision which occurred between an automobile that he was operating and another automobile which was being operated by one Daniel Calvin Smith. It was alleged in plaintiff’s amended complaint that at the time of the collision Smith was acting as the employee and agent of the defendants George Engebreeht and James McClatchy Publishing Company and was in the course of his employment and that the collision and plaintiff’s consequent injuries were caused by…
