OPINION

RICHARD MILLS, District Judge:

A civil rights lawsuit against two state police officers.

We grant them summary judgment.

I. Facts

The facts of this case are relatively simple and undisputed.

The Plaintiff, Raymond Dykhouse, was employed as a truck driver for Herrud & Co. and en route with a load of cargo to Jacksonville, Illinois, on May 27, 1986. At approximately 4:00 p.m. that afternoon a truck travelling northbound on U.S. Route 67 near Medora in Macoupin County illegally passed Gloria Barkley causing her to swerve sharply to the right to avoid a collision.
