Judgment unanimously modified, without costs, and as modified affirmed and case remitted to Court of Claims for further proceedings in accordance with the following memorandum: The State partially appropriated claimant’s lands in the Town of Hinsdale, Cattaraugus County, in connection with the Southern Tier Expressway project. Claimant appeals from the judgment of the Court of Claims which awarded him $31,130 plus interest.
