The plaintiff in error, Clem Jenkins jr., was charged with the murder of Jim Wilson, and was convicted of *524voluntary manslaughter. The court declined to grant the accused a new trial, and he excepts to the judgment overruling his motion therefor.

Counsel for the accused insists that the evidence did not warrant a finding of voluntary manslaughter, and that the court erred in charging the jury as to the law bearing on that grade of homicide.
