Eoche, were partners in business under the firm name of the' Southern Utah Mercantile & Lumber Company; that the defendants were indebted to Lowenberg & Co., a copartnership at San Francisco, for goods sold and delivered to the defendants to the value of $579, an assignment thereof to plaintiff, and non payment of the debt.
