This is an application for a mandamus by the appellant against the appellees, to require the latter to levy the sum of $40,100.41, to the use of the former, for taxes alleged to have been erroneously levied and paid. The supposed right to relief is founded upon the Code, Art. 28, sec. 1, which provides that the County Commissioners *257shall, “ when satisfied that any error has arisen hy assessing property not liable to he assessed, rectify such error and levy and pay to the proper person any money that may have been paid in consequence of such error.”
