This is an appeal from a decree of the district court of Nance county, by which plaintiff’s title to certain real-property in said county was confirmed to the exclusion of the rights of appellant Burke. Briefly stated, the facts involved are as follows: On January 27, 1887, there was rendered in favor of the plaintiff, in-the circuit court of *768the United States for the district of Nebraska, a judgment in the sum of something over $3,000 against J.
