Petitioners in this case, James B. Orr (Orr) and Highway Express, Inc. (Highway), request a review of the decision of the Interstate Commerce Commission (ICC) that found their attempt to collect “undercharges” from Sewell Plastics, Inc. (Sewell) to be an “unreasonable practice.” The petitioners have asked this court to reconsider the decision based on the assertion that the ICC cannot administratively change the long-standing “filed rate doctrine.” After considering the briefs of all parties in this…
