*669 MEMORANDUM OPINION AND FINAL ORDER

This matter comes before the court on petitioner Mohamed Hassan Soliman’s (“Solimán”) motion to vacate, set aside, or correct his sentence, filed under 28 U.S.C. § 2255. The government submitted a response in opposition, to which Solimán replied. The court held an evidentiary hearing on June 8, 2009, on the narrow issue of whether Solimán asked his counsel to file an appeal.1 Both parties submitted additional materials to the court prior to the hearing, and this matter is now ripe for decision.
