Appeal from an order of the Family Court of Broome County (Ray, J.), entered January 15, 2003, which, inter alia, dismissed petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, for physical custody of the parties’ child.
The parties, parents of Gregory (born in February 2002), separated in July 2002 and filed separate custody petitions in Family Court. Following a hearing, Family Court awarded the parties joint legal custody with primary residence of the child in respondent.
