This appeal involves an insurance coverage dispute between plaintiff/counterdefendant, Travelers Froperty Casualty Company of America (plaintiff), and defendant/counterplaintiff, Feaker Services, Inc. (defendant). The trial court denied plaintiffs motion for summary disposition under MCR 2.116(C)(10) and granted summary disposition in favor of defendant under MCR 2.116(1)(2). The trial court held that plaintiff had a duty to defend and indemnify defendant in a separate breach-of-contract action pursuant to the commercial general liability (CGL) insurance policy that it issued to defendant.…
