Defendant was convicted on a charg’e of breaking* and entering in the daytime with intent to commit larceny. He appeals, claiming* error on the ground that the verdict was against the overwhelming* weight of evidence; that there was no proof of venue on the preliminary examination; and that the court erred in neglecting to define the crime of larceny in its charge to the jury.
