GARDNER, Chief Justice.
The appeal is from the decree rendered March 3, 1943, sustaining the demurrer to complainant’s bill as last amended, which appears to be filed in a double aspect. First, complainant seeks the cancellation of a mortgage executed to the defendant Federal Land Bank by his mother, Ada O. Sherrill, and his father, John W. Sherrill, in June 1922. The mother died in February, 1923, and the father in November, 1940. The land embraced in this mortgage is alleged to have been the property of complainant’s mother, Ada O.
