The plaintiff, a taxpayer and resident of the city of Fargo, seeks to enjoin the defendant from offering for sale, selling, executing, or delivering certain bonds for the purpose of obtaining funds to erect, enlarge, improve, furnish and equip school buildings in the territory under the jurisdiction of the defendant. The sole question in controversy is whether the defendant is a public corporation, having a legal entity separate and distinct from the city of Fargo, or is merely a board or department of the government of the city of Fargo.
