The lower court had granted summary judgment in favor of Allegheny Power Company (hereinafter “APC”), the State of West Virginia Bureau of Commerce, Division of Natural Resources (hereinafter “DNR”), and the State of West Virginia Department of Transportation, Division of Highways (hereinafter “DOH”).
