Deborah H. Jividen, appellant/defendant below (hereinafter referred to as “Ms. Jivi-den”), appeals from an order of the Circuit Court of Kanawha County denying her Rule 60(b) motion. Ms. Jividen seeks to have the circuit court set aside a provision in the divorce decree that awarded her former spouse, Dale Ray Jividen, appellee/plaintiff below (hereinafter referred to as “Mr. Jivi-den”), the home the couple resided in during the marriage.
