The plaintiff alleged its corporate existence and the power to establish and maintain the public highways and bridges in Charlotte Township, Mecklenburg County, and to do all things necessary and incidental to the exercise of such, power; that the defendant was a corporation with power and authority to buy, sell, hold and deal in suburban and other real estate in the county aforesaid.

3. That prior to the 19th day of July, 1901, the defendant was and is still the owner of a large tract of land just east of the city of Charlotte, which is divided up into building lots and thrown upon the market…
