Timothy G. Smith (“Appellant”) appeals from the probate division of the Polk County circuit court’s judgment finding him to be a sexually violent predator (“SVP”) pursuant to section 632.480(5)(a) 1 and committing him to the custody of the director of the Department of Mental Health (“DMH”) for control, care, and treatment pursuant to section 632.495.
