Tilson, Judge:

This suit was filed by the plaintiff seeking to recover a certain sum of money alleged to have been illegally exacted as customs duties on certain imported merchandise. Duty was levied on said merchandise at 90 per centum ad valorem under paragraph 1529 (a) of the Tariff Act of 1930, and the plaintiff claims the same to be properly dutiable at only 40 per centum ad valorem under paragraph 385 of said act, as amended by the French Trade Agreement, T. D. 48316, as woven fabrics wholly or in chief value of any of the materials provided for in paragraph 385.
