Colwell, District Judge.

Defendants, Richard M. Glidden and Cynthia J. Glidden, appeal from a judgment granting plaintiff a realtor’s commission. Defendants sold their house themselves before the listing agreement expired.

The issues were first litigated in the county court of Buffalo County, Nebraska, upon plaintiff’s petition and defendants’ answer and cross-petition for damages. Defendants alleged unfair acts on the part of the plaintiff under section 59-1602, R. R. S. 1943. The county court dismissed both the petition and cross-petition.
