This is an appeal from a judgment entered upon a verdict directed in favor of defendant.

It appears that Lalonde, Peck and Powers, in September, 1924, entered into a contract with the state highway commission to construct what is known as the Babb-Cardston road in Glacier county, Federal Aid Project No. 208-A. In October, 1924, the contractor entered into a subcontract with C. H. Windsor, whereby the latter agreed to furnish all materials, tools,, machinery and equipment and to do and perform all of the work and labor provided for in the contract between the contractors and the state.
