Appeal from a judgment of the Supreme Court (Donohue, J.), entered July 31, 2007 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of the Board of Parole denying petitioner’s request for parole release.

In 1987, petitioner was convicted of murder in the second degree, criminal possession of a weapon in the second degree, attempted criminal possession of a controlled substance in the third degree and attempted criminal possession of a forged instrument in .the second degree.
