The underlying civil action is a suit for damages based on an alleged breach of a homeowner’s policy. The real party in interest, Minerva Martinez, filed suit against relators, Allstate Texas Lloyd’s and David Radigan (“Allstate”), 1 for breach of contract and extra-contractual “bad faith” claims under the common law, the Texas Insurance Code, and the Texas Deceptive Trade Practices Act.
