This matter is before the Court on the Federal Deposit Insurance Corporation’s (“FDIC”) Motion to Dismiss Amended Third Amended Complaint (“Third Amended Complaint”) in Case No. 12-cv-00240 (Adams I ).1 (Doc. # 75.)
