Relator seeks a writ of mandate to compel the respondent, as county clerk of Cascade county, to accept and file his petition and filing fee as a candidate for nomination for the office of sheriff of that county at the primary election to be held in July, 1942. There are no disputed facts and this court has accepted original jurisdiction as necessary and proper to the complete exercise of its appellate jurisdiction, time not permitting trial in district court and disposition here on appeal.
