Appeal from a judgment of the superior court for Pierce county, Shackleford, J., entered June 2, 1909, upon the verdict of a jury rendered in favor of the defendant, in an action for personal injuries sustained by a brick mason in the fall of a wall.

On and for some time prior to the 21st day of July, 1908, the defendant was engaged in the construction of the armory, at Tacoma, under contract with the state. The plaintiff was in his employ as a mason or bricklayer. On the above date the brick wall on the 11th street side of the building had been constructed to a height of from 25 to 30 feet above the street level, and was thirteen inches in thickness at the top.
