This case is before the Court upon the appeal of Floyd Lee DeGraw from the July 25, 1994, final order of the Circuit Court of Mercer County sentencing the Appellant to a term of life imprisonment without possibility of parole following a jury conviction of first degree murder without a recommendation of mercy.
