HODGE, CJ.

Appellant Roland G. Murrell (hereafter “Murrell”) requests that this Court reverse his convictions for driving under the *345influence and negligent driving on the grounds that the Superior Court’s invocation of 14 V.I.C. § 4 deprived him of his constitutional right to a trial by jury. For the reasons that follow we will reverse the Superior Court’s July 17, 2008 Judgment and remand the matter to the Superior Court for a new trial.
