The jury found that'William Dewayne White knowingly delivered less than one gram of methamphetamine in a drug-free zone, a third degree felony. 1 After the trial court found one of the State’s enhancement allegations “true,” White was sentenced to fifteen years’ imprisonment.

On appeal, White argues (1) that the trial court erred in recalling and seating an alternate juror who was allowed to leave the courtroom after the charge was read to the jury, (2) that the statute for,the offense is unconstitutional because it fails to require a culpable mental state, and…
